Privacy policy

This Privacy Policy describes how Apex Hardware NY Corp (“Apex Hardware NY,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with apexhardwareny.com, our online store, purchases, customer accounts, communications, and related products, services, features, and tools (collectively, the “Services”).

Our online store is hosted by Shopify, which provides the commerce platform through which we offer the Services. If this policy conflicts with our Terms of Service, this policy controls solely with respect to the collection, use, processing, and disclosure of personal information.

Please review this policy carefully. By accessing or using the Services, you acknowledge the privacy practices described below.

Personal Information We Collect or Process

“Personal information” means information that identifies, relates to, describes, or can reasonably be linked with an identified or identifiable individual. It does not include information collected anonymously or information that has been de-identified so that it cannot reasonably be linked to an individual.

The personal information we collect or process depends on how you interact with the Services, where you reside, and applicable legal requirements. It may include:

Contact information. Name, billing address, shipping address, email address, and telephone number.

Order and transaction information. Products purchased, returned, exchanged, or canceled; order history; delivery information; discounts; payment status; and related transaction records.

Payment information. Shopify and our payment processors collect the payment-card, financial-account, billing, and authentication information required to process payment. We generally receive billing information, payment confirmation, transaction status, payment method, and limited payment-card details rather than a full payment-card number. Apex Hardware NY does not store full payment-card numbers in its own systems.

Account information. Login credentials, saved addresses, account preferences, and settings associated with a customer account.

Shopping and preference information. Products viewed or searched for, items placed in a cart or saved to a wishlist, product interests, and related shopping activity.

Communications and support records. Information submitted in connection with an inquiry, quote, return, warranty request, survey, promotion, or other communication with us.

Submitted content. Product reviews, ratings, photographs, comments, and other content you choose to provide.

Device and technical information. IP address, browser type, device type, operating system, network connection, cookie identifiers, and other unique identifiers.

Usage information. Information concerning when and how you access, navigate, and interact with the Services, our emails, and our advertisements.

Marketing and advertising information. Communication preferences, interactions with marketing materials, and information used to measure or personalize advertising.

We may derive inferences from the categories described above to understand preferences, improve the Services, or provide more relevant content and advertising. We do not use or disclose sensitive personal information to infer characteristics about you.

You may decline to provide personal information, but we may be unable to complete a transaction, respond to a request, or provide certain features when the requested information is necessary for those purposes.

Sources of Personal Information

We may collect personal information:

Directly from you when you place an order, create or use an account, contact us, request service, submit content, or otherwise provide information to us.

Automatically through the Services from your browser or device and through cookies, pixels, tags, software development kits, and similar technologies.

From Shopify and service providers that support payments, fraud prevention, hosting, search, analytics, advertising, customer service, product reviews, order fulfillment, shipping, returns, and other business operations.

From business partners and other third parties, including marketing and advertising partners, manufacturers, distributors, social-media platforms, and services you elect to use in connection with the Services.

How We Use Personal Information

We may use personal information for the following purposes:

Operating and improving the Services. We use personal information to display products, maintain website functionality, remember preferences, improve search results and performance, evaluate use of the Services, and develop or refine features.

Processing transactions and providing support. We use personal information to facilitate payments; fulfill, ship, track, service, return, or exchange orders; maintain accounts; send transaction notices; respond to inquiries; provide customer support; and administer reviews.

Marketing and advertising. We use personal information to send promotional communications where permitted, measure marketing performance, and display or facilitate advertising based on activity involving the Services or other websites. Promotional emails may be discontinued at any time through the unsubscribe link provided in the message.

Security and fraud prevention. We use personal information to authenticate accounts and transactions; identify, investigate, prevent, or respond to suspected fraud, unlawful activity, malicious conduct, security incidents, or threats to safety; and protect our customers, the Services, our business, and others.

Business communications. We use personal information to respond to requests, provide operational notices, and administer our business relationship with you.

Legal and administrative purposes. We use personal information to comply with applicable law and valid legal process; enforce or investigate possible violations of our terms and policies; establish, exercise, or defend legal claims; resolve disputes; maintain records; conduct audits; and support an actual or proposed financing, merger, acquisition, reorganization, bankruptcy, or sale of assets.

Where applicable law requires a legal basis for processing, we rely on the performance of a contract, compliance with a legal obligation, our legitimate business interests, the protection of vital interests, consent, or another lawful basis, as appropriate.

Cookies and Similar Technologies

We, Shopify, and authorized partners use cookies and similar technologies to operate the Services, preserve preferences, secure accounts and transactions, analyze use, improve performance, measure marketing, and personalize content or advertising.

Certain cookies are necessary for the Services to function. Others support preferences, analytics, performance, or advertising. Information regarding cookies used by Shopify is available in Shopify’s Cookie Policy.

You may manage cookies through your browser controls and, where available, through the Cookie Preferences link or privacy banner on our website. Blocking or deleting cookies may affect the availability or operation of certain features. Cookie choices generally apply only to the browser and device on which they are made.

How We Disclose Personal Information

We may disclose personal information as reasonably necessary for the purposes described in this policy:

To Shopify, which hosts and supports our online store and provides commerce, payment, security, analytics, personalization, and related services.

To vendors and service providers that support website hosting, information technology, payment processing, fraud prevention, analytics, search, cloud storage, customer support, communications, product reviews, returns, and other business operations.

To manufacturers, distributors, fulfillment partners, and carriers as necessary to quote, fulfill, deliver, service, return, replace, or otherwise administer an order.

To marketing, advertising, analytics, and other business partners that promote the Services, measure performance, evaluate customer activity, or provide more relevant advertising. A recipient acting independently processes information under its own privacy notice.

At your direction or with your consent, including when you elect to use a third-party integration, social-media feature, or payment option.

To affiliates and professional advisers, including accountants, auditors, insurers, attorneys, financial institutions, and other advisers where reasonably necessary to operate or protect our business.

For legal, safety, or business-transition purposes, including to comply with law or valid legal process, enforce our terms or policies, protect rights or safety, investigate fraud or security matters, or support an actual or proposed financing, merger, acquisition, reorganization, bankruptcy, or sale of assets.

The categories disclosed may include identifiers and contact information, commercial and transaction information, device and usage information, communications, and limited payment information, depending on your interaction with the Services.

Our Relationship with Shopify

Shopify hosts the Services and processes personal information concerning access to and use of the Services in order to provide, protect, and improve its platform for us and for you. Information submitted through the Services is transmitted to Shopify and may be transmitted to service providers located outside the country in which you reside.

We use Shopify Network Intelligence and other enhanced Shopify features that incorporate information from your interactions with our store, Shopify, and other merchants to protect, operate, improve, and grow our business. For processing undertaken to provide those enhanced features, Shopify is responsible for its processing of personal information, including responses to requests concerning that processing.

Additional information concerning Shopify’s practices and the rights available to you is provided in the Shopify Consumer Privacy Policy and through the Shopify Privacy Portal.

Sale, Sharing, and Targeted Advertising

We do not sell personal information in exchange for money. Certain disclosures to advertising or marketing partners, and the use of certain Shopify enhanced services, may nevertheless be considered a “sale,” “sharing,” or processing for “targeted advertising” under applicable privacy laws, even when no money is exchanged.

Depending on where you reside, you may have the right to opt out of those activities. You may submit an opt-out request through our Your Privacy Choices page or by contacting us. Choices relating to Shopify’s independent processing may also be submitted through the Shopify Privacy Portal.

When a legally recognized Global Privacy Control (GPC) signal is enabled, we treat the signal as an opt-out request for the browser and device transmitting it where required by applicable law. If Shopify can associate the device with a Shopify account, the request may also be applied to that account. We do not currently recognize other browser-based “Do Not Track” signals.

User-Generated Content

The Services may permit the submission of product reviews, photographs, comments, or other user-generated content. Content submitted to a public area of the Services may be accessible to any visitor. Do not include information in public content that you do not wish to make publicly available.

We do not control how third parties use information that you make public and cannot guarantee that they will preserve its confidentiality or security. Except as required by law, we are not responsible for the privacy or security of information you voluntarily disclose in a public area.

Third-Party Websites and Services

The Services may contain links to websites, applications, payment methods, social-media platforms, or other services operated by third parties. We do not control and are not responsible for the privacy, security, content, accuracy, or practices of those third parties. The inclusion of a link does not, by itself, constitute an endorsement. Review the applicable third-party privacy notice and terms before providing information or using the service.

Children’s Data

The Services are not directed to children under the age of majority in their jurisdiction, and we do not knowingly collect personal information from children. A parent or legal guardian who believes that a child has provided personal information to us may contact us to request its deletion.

We do not have actual knowledge that we sell or share, as those terms are defined by applicable law, the personal information of any individual under 16 years of age.

Security and Retention

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, acquisition, use, alteration, disclosure, or destruction. No safeguard or method of transmission is completely secure, and we cannot guarantee absolute security. Sensitive or confidential information should not be transmitted through an unsecured channel.

We retain personal information for as long as reasonably necessary to provide the Services, maintain accounts, complete and document transactions, provide customer support, administer applicable warranties, prevent fraud, satisfy legal, tax, accounting, and recordkeeping obligations, resolve disputes, enforce agreements, and maintain appropriate backups. Retention periods vary according to the nature of the information, our relationship with you, and applicable legal requirements.

Your Rights and Choices

Depending on your jurisdiction and subject to applicable exceptions, you may have one or more of the following rights:

Access or knowledge. The right to request personal information maintained about you and, where applicable, information concerning its use and disclosure.

Deletion. The right to request deletion of certain personal information maintained about you.

Correction. The right to request correction of inaccurate personal information maintained about you.

Portability. The right to receive certain personal information in a portable and, where required, readily usable format.

Opt out of sale, sharing, or targeted advertising. The right to opt out of activities falling within those definitions under applicable law.

Restriction or objection. The right to restrict or object to certain processing in circumstances recognized by applicable law.

Withdrawal of consent. The right to withdraw consent where processing is based on consent. Withdrawal does not affect processing lawfully conducted before consent was withdrawn.

Appeal. The right to appeal a decision concerning a privacy request where applicable.

Communication preferences. Promotional emails may be discontinued through the unsubscribe link or other method included in the communication. We may continue to send non-promotional messages concerning accounts, orders, transactions, or an existing business relationship.

Privacy rights are not absolute and may be limited or denied where permitted or required by law.

How to Exercise Your Rights

A privacy request may be submitted through a method made available through the Services, our Your Privacy Choices page, or by contacting us using the information below. Requests concerning Shopify’s independent processing should be submitted through the Shopify Privacy Portal.

We may verify your identity before processing a request, as permitted or required by law. Verification may require an email address, order information, account details, or other information reasonably necessary to confirm identity and document the request.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require proof of the agent’s authority and direct verification of your identity. We will respond within the period required by applicable law and will not discriminate against you for exercising a privacy right.

Complaints and Appeals

Questions or complaints concerning our processing of personal information should be submitted using the contact information below. Where applicable, a denial may be appealed by replying to our decision or submitting a new communication with “Appeal” in the subject line. You may also have the right to lodge a complaint with an appropriate data-protection authority.

International Transfers

We are based in the United States. Personal information may be transferred to, stored in, or processed in the United States and other countries in which Shopify or our service providers operate. The privacy laws of those countries may differ from those of your jurisdiction.

Where required for a transfer from the European Economic Area, the United Kingdom, or another jurisdiction with cross-border transfer requirements, we rely on recognized safeguards such as an adequacy decision, the European Commission’s Standard Contractual Clauses, the applicable United Kingdom transfer mechanism, or another lawful transfer method.

Changes to This Policy

We may revise this policy to reflect changes in our practices, the Services, or applicable legal and regulatory requirements. A revised policy will be posted on this website, together with any additional notice required by law.
